Two Brooklyn Park men were sentenced to serve two years of probation for supplying alcohol to a Prior Lake man who died after he fell from the third floor of a parking ramp last year.
Michael McCullough and Brandon Overlie were charged in Hennepin County District Court on Wednesday with the death of Kyle Sharbonno, 19, who slipped from a ledge and fell from the third level of the Oak Street parking ramp on the University of Minnesota campus at approximately 1:36 a.m. April 1, 2007.
According to the criminal complaint, Sharbonno attended a party hosted by McCullough on March 31 in Minneapolis. During the investigation, McCullough told police he obtained kegs of beer for a “beer pong” tournament held at his house on March 31. Beer pong is a popular college drinking game. In order to participate, the people at the party paid $5 for a cup and McCullough allowed the participants to drink from any of a number of kegs in the house.
McCullough was not 21 years old at the time of the party. He told police that his roommate, Overlie, bought the kegs and brought them to the house. Overlie was not at the party but admitted to buying the kegs with his identification and credit card, according to the criminal complaint.
After leaving the party, Sharbonno fell from the parking ramp.
At 2:21 a.m. on April 1, Sharbonno’s blood alcohol content was .31, according to the complaint. Sharbonno later died of head injuries at Hennepin County Medical Center. He was a 2006 Prior Lake High School graduate.
McCullough, 21, and Overlie, 22, also were sentenced to complete 80 hours of community service, spend two months in the workhouse plus another six months on electronic home monitoring and complete a 16-hour alcohol awareness counseling course.
